Terms and Conditions

1. Acceptance of Terms

By registering for and attending a Bayside Health Allied Health Learning Hub event, participants agree to comply with these Terms and Conditions and any applicable Bayside Health policies, procedures, codes of conduct, and venue requirements.

In these Terms and Conditions "Organisation" means Bayside Health (ABN 52 892 860 159).

2. Registration

2.1 Registration is required for attendance unless otherwise specified.

2.2 Registration is not confirmed until:

• A completed registration form has been received;
• Any applicable fees have been paid; and
• Confirmation has been issued by the organiser.

2.3 The Organisation reserves the right to:

• Refuse or cancel a registration;
• Limit participant numbers;
• Prioritise attendance based on eligibility criteria, workplace requirements, or available places.

2.4 Registrations are generally non-transferable unless approved by the organiser.

3. Fees and Payment

3.1 Payment must be made in full at the time of registration. Payment plans and payment by invoice are not available for these events.

3.2 Any fees advertised are inclusive of GST unless otherwise stated.

4. Cancellations and Refunds

4.1 Refunds

• A participant who cancels more than 30 days before the event will be entitled to a refund of 80% of the registration fee.
• A participant who cancels 30 days or less before the event will not be entitled to a refund.
• Cancellation must be in writing: please contact the course provider at ahlearninghub@alfred.org.au as soon as possible to discuss options

4.2 In very rare cases, due to clinical demand or circumstances beyond the Organisation's reasonable control, courses may need to be cancelled. In this instance, registrants will be advised urgently and will receive a full refund for registration fees. The Organisation reserves the right to cancel, postpone, amend, reschedule, or change the format of an event or its presenters at any time.

4.3 The Organisation is not responsible for any costs incurred by participants, including travel, accommodation, or other consequential expenses associated with event cancellation or changes.

5. Attendance and Participation

5.1 Participants are expected to:

• Behave professionally and respectfully;
• Comply with all reasonable directions provided by event staff;
• Maintain a safe and inclusive learning environment; and
• Treat all participants, presenters, patients, consumers, and staff with dignity and respect.

5.2 Disruptive, inappropriate, discriminatory, harassing, aggressive, or unsafe behaviour may result in removal from the event without refund.

5.3 Participants must not attend if doing so would breach workplace restrictions, public health requirements, or other applicable safety directives.

6. Health, Safety and Risk Management

6.1 Participant safety is a priority. Attendees must comply with:

• Workplace health and safety requirements;
• Emergency procedures;
• Infection prevention and control requirements;
• Relevant Organisational policies and procedures.

6.2 Participants attend and participate at their own risk.

6.3 The Organisation may remove any participant whose conduct is considered unsafe or poses a risk to themselves or others.

7. Educational Content and Clinical Information

7.1 Event content is provided for educational and professional development purposes only.

7.2 Information presented during the event should not be considered specific clinical, medical or professional advice and should not be relied upon as such.

7.3 Participants remain responsible for:

• Applying professional judgment;
• Working within their scope of practice;
• Ensuring they have the necessary qualifications, supervision, approvals and competence to undertake any professional activities.
• Complying with professional standards, registration requirements, workplace policies, and relevant legislation.Maintaining any professional registration, accreditation, certifications, licences or continuing professional development requirements applicable to their profession.

7.4 Participation in, or completion of, the event does not constitute accreditation, credentialling, endorsement, certification of competence, granting of clinical privileges, or authorisation to perform any clinical activity.[

7.5 The Organisation does not warrant that educational content is free from errors or that it remains current after the date of presentation.

8. Privacy and Personal Information

8.1 Personal information collected during registration and event administration will be managed in accordance with:

• Applicable privacy legislation; and
• The Organisation's Privacy Policy.

8.2 Information may be collected for purposes including:

• Event registration and administration;
• Communication regarding the event;
• Evaluation and quality improvement activities;
• Continuing professional development records; and
• Reporting requirements.

8.3 Participant information will not be disclosed except where authorised by law or permitted under the Organisation's Privacy Policy.

9. Confidentiality

9.1 Participants may be exposed to clinical, organisational, educational, or case-based information during the event.

9.2 Participants must:

• Maintain confidentiality;
• Not disclose confidential information obtained during the event;
• Comply with all privacy obligations relating to patients, staff, consumers, and the Organisation.

9.3 Participants must not disclose identifiable patient information during event activities. Any clinical information shared by participants must be appropriately de-identified.

9.4 Recording, sharing, photographing, or distributing confidential information is strictly prohibited.

10. Photography, Recording and Media Consent

10.1 The Organisation may photograph, record, livestream, or otherwise capture event activities for educational, communication, promotional, and reporting purposes.

10.2 By attending the event, participants acknowledge that they may appear in photographs, video recordings, livestreams, or other media.

10.3 Participants who do not wish to be photographed or recorded should notify the organiser prior to the event. The Organisation will take reasonable steps to accommodate such requests but cannot guarantee that participants will not be incidentally captured in group photographs, recordings or livestreams.

10.4 Participants must not make audio or visual recordings of sessions without prior written permission from the organiser.

11. Intellectual Property

11.1 All event materials, presentations, resources, recordings, and educational content (Materials) remain the intellectual property of the Organisation, presenters, or relevant rights holders unless otherwise stated.

11.2 The Materials may contain copyright content made available to you by the Organisation under a statutory educational licence (Copyright Act 1968 (Cth)). The Materials are provided only for your personal educational use in connection with your registration in the event. Participants must not share, publish, distribute or otherwise make this material available outside the Organisation.

11.3 Participants must not:

• Reproduce;
• Publish;
• Distribute;
• Sell;
• Modify; or
• Commercially exploit

any Materials without prior written permission, except as authorised by law.

11.4 Without limiting clause 11.3, participants must not upload Materials to websites, file-sharing services, learning management systems, artificial intelligence platforms, or other third-party systems without prior written permission from the Organisation.

12. Liability

12.1 To the maximum extent permitted by law, the Organisation excludes all liability arising from participation in the event, reliance on the Materials, or use of information presented during the event.

12.2 The Organisation is not liable for any exemplary or economic loss or loss of opportunity arising from or in connection with the event.

12.3 Where liability cannot be excluded by law, the Organisation's liability is limited to resupply of the event or refund of the registration fee paid by the participant.

13. Governing law

13.1 These Terms and Conditions are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria.
